Separate T & C’s for events/weddings

1. General 

1.1 The rental contract is between the Renter (You), named in the Booking, and APESA Properties Limited (APESA). The Property is located at: Villa Stari Mlin, Zabrdje, Tivat 85323, Montenegro.

The villa is to be occupied for private use only. It cannot be sublet and the Villa can only be occupied by those persons whose names are listed in the Guest details. Any changes to the intended occupants must be notified to APESA by email.

 1.2 Maximum occupancy: The maximum number of guests in the villa is limited to 10 persons, including children over the age of 2. If there are additional guests, max two children, there will be an additional charge of £25 per person per night.

 1.3 The Renter warrants that he/she has the authority to accept these Conditions on behalf of the entire party listed in the Booking (including those substituted or added at a later date) and is responsible for ensuring that each member of the party is informed of and complies with the Terms and Conditions of the Booking.  

1.4 APESA is not responsible for minor differences (for example in furnishing) between the description of the Villa on the website and the Villa as found on arrival.  

1.5 APESA reserves the right to refuse to accept a Booking without giving a reason.

1.6 The Renter consents to APESA retaining his/her contact information for the purpose of arranging the accommodation booked and ancillary services. APESA will only email you about special offers and holiday ideas if you have confirmed that you want to receive such emails. APESA will not pass your contact details to any third party or organization other than in connection with dealing with your enquiry or through the sale or transfer of the business to new ownership.  

1.7 This Agreement and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) shall be governed and construed in accordance with the law of England and Wales. The parties irrevocably agree that the English Courts shall have exclusive jurisdiction to settle any such dispute or claim that arises out of or in connection with this Agreement (including non-contractual disputes or claims).  

2. Payment  

2.1 25% of the total amount is due at the time of booking, with the remaining balance due 60 days before arrival.

The balance of the full payment is due 60 days prior to the first day of occupancy, unless other payment terms have been agreed and confirmed in writing by APESA. Payment should be made to "APESA Properties Ltd" in accordance with the payment instructions provided.

2.2 Where the Renter has not paid the balance by the required date APESA reserves the right to cancel the Booking.

2.3 The initial deposit and balance payment is to be paid by bank transfer. All bank charges for the transfer are to be bourne by the guest.

2.4 If payment is made by bank transfer APESA will cover its own bank charges but the Renter should ensure that the sending banks charges are charged to his/her own account. 

2.5 APESA reserves the right to alter advertised prices at any time and to correct errors in advertised or confirmed prices. 

3. Booking  

3.1 Booking is made at the point when APESA receives the payment of a deposit. APESA reserves the right to cancel the Booking at any time should the villa become unavailable for use due to circumstances beyond the control of APESA, in which case a full refund will be made of any monies paid. 

 3.2 All villas have a maximum number of 10 occupants permitted. APESA may terminate the Booking without notice and without refund, if the number of persons arriving at the villa exceeds the limit.  

4. Cancellation  

Notification of cancellation must be made by email to APESA. The date of cancellation is the date at which APESA receives valid notice of cancellation. The following terms apply: 

a) 100% of paid pre-payments are refundable if you need to cancel your stay 60 days before arrival or earlier (excluding a £100 admin fee).

b) 50% of paid pre-payments are refundable if you need to cancel between 30 and 60 days before first day of occupancy, a 50% refund will be issued (excluding a £100 admin fee).

c) For cancellations less than 30 days before arrival, including any no-shows or early departures, the owner will keep/charge the full balance, so 0% refundable.

5. Damages and breakages  

The Renter is liable for the replacement or repair cost resulting from any damage or breakages caused. The Villa should be vacated in the same state of repair and cleanliness as it was found.

A refundable damage deposit of £750 is charged at time of booking, with 25% taken with the initial rental deposit, and the remaining 75% is collected with the final payment, 60 days prior to rental start date. 

The refundable damage deposit is released 7 days after departure via direct bank transfer. (subject to any retentions). 

We recommend that you and other members of your party take out travel insurance to cover you for loss of deposit if you have to cancel your holiday due to illness and for losses or injury arising during your stay.

6. Prohibited activities 

6.1 Pets are not permitted in the Villa or its grounds without prior approval from APESA. There is a surcharge of £50 per animal per stay, if permitted.

6.2 No diving is permitted in the pool.  

6.3 All members of the party must behave appropriately having regard to the Villa location and the impact of noise on neighbours. Occupants and their visitors must not act inappropriately, offensively or dangerously.  

6.4 APESA reserves the right to terminate the Booking with immediate effect without compensation if the behaviour of any individuals within the party carry out a prohibited activity as specified in this condition.  


7. Arrival and departure 

All bookings are for periods specified in the Booking or for other such periods as has been agreed in writing by APESA. The Villa must be vacated by 10:00 on the day of departure and arrival should not be before 16:00 unless alterations to these arrangements have been agreed. 

8. Liability  

The amenities of the property shall be used entirely at the Renter‘s own risk. APESA is in no circumstances liable for any loss or damage to any valuables belonging to the occupants or any visitors of the Villa. APESA excludes any liability for death or personal injury of any person occupying or visiting the Villa (including any associated outdoor space) to the full extent permitted by law. Occupants are advised to take care whilst walking with wet feet on stone, tile or marble surfaces that may be slippery.  

9. Insurance  

APESA requires You and other members of your party take out travel insurance to cover You for loss of deposit if You have to cancel Your holiday due to illness and for losses or injury arising during Your stay.  

10. Force Majeure

In respect of all bookings the Homeowners shall not be held liable for any loss, damage or expense incurred or suffered which results from the following: strike, civil commotion, fire, flood, power cuts, war, threat of war, terrorism, national or nuclear disaster, late delivery, adverse weather condition or any Act of God or any other event which is outside the reasonable control of the Houseowners. 

11. Right of entry  

APESA or its agents have the right of entry to the Villa at any time to perform general housekeeping, carry out inspections, make repairs or attend to the pool and/or garden.  

12. Choice of Law/Jurisdiction: This agreement is subject to the laws of England and any disputes arising out of it are justiciable in the courts of England. 

13. You, the renter, agree to the following rental rules: 

i) Smoking is allowed outside only.

ii) People other than those in the Guest party set forth above may not stay overnight in the property. Any other person in the property is the sole responsibility of Guest. Guests are not allowed to exceed the occupancy limit agreed to above.

iii) Guests should not create excessive noise at a level that disturbs neighbours; Code-enforced neighborhood quiet hours are from 11:00p.m. – 8:00a.m.

iv) No pyrotechnics allowed on site.

v) The owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

vi) Keep the property and all furnishings in good order

vii) Only use appliances for their intended uses

viiii) Parking:

Parking is limited to 3 vehicle(s), 2 in the gated parking area, and 1 outside the gated parking area in the road. The Homeowners will not be held responsible for damage to vehicles and vehicles are parked at the risk of the Guest. 

ix) Housekeeping:  There is a daily housekeeping service. Towels for bathrooms and the pool are provided, but we would ask that you bring your own beach towels. We do not permit towels or linens to be taken from the units. Please do not help yourself to towels, as this creates a lot of extra work for the housekeeper, and is also wasteful of water. Towels and linens will be changed weekly. 

x) Rubbish: Please put rubbish in bins which are provided in each bathroom and in the kitchen. The refuse areas are in the village by the road side.

xi) Swimming pool : No children under the age of 10 permitted in the swimming pool at any time without adult supervision. The Homeowners will not be held responsible for the Guest’s use of the swimming pool. 

xii) Security: Guest(s) must ensure that when they are not at the Property, the Property is locked and left properly secure. The Homeowners will not be held responsible for any loss of or damage to belongings of the Guest during their stay at Villa Stari Mlin.
